Defects between spouses (a comparative jurisprudential study)
Main Article Content
Abstract
Praise be to Allah, Who is unique in perfection and is free from shortcomings, defects and bad qualities. Then prayers be upon the Prophet Muhammad, his companions and his family. And after. Allah the Almighty said (O mankind, fear Him who created you from one soul and created from it its mate and dispersed from both of them many men and women.) Allah created people from male and female for the continuation of the human race until Allah inherits the earth and those on it. He made for this a strong bond, which is the legal contract of marriage. He took into account everything that would preserve the continuity of this great bond. Some congenital defects were found that disturb the serenity of this heavenly bond, including defects specific to men such as impotence, impotence, castration and intercourse. And defects specific to women such as atresia, horniness and hernia. There are defects shared by men and women, including insanity, leprosy, vitiligo, urinary incontinence, hemorrhoids, fistula and the like. Each defect has effects and rulings that result from it according to the requirements of Islamic law. Thus, Islam guarantees the rights of spouses.
